The Attorney-General’s office has defended the government’s funding of the National Cathedral project, stating that all payments made towards the project were lawful and drawn from the Contingency Vote, categorized under “Other Government Obligations”.

This response comes after a private citizen, Jonathan Amable, filed a lawsuit at the Supreme Court, challenging the constitutionality of the funding. Amable claims that the funding breaches Article 179(11) of the Constitution, which requires prior approval from the Speaker of Parliament and the Chairperson of the Council of State.

However, the AG’s office argues that the project is 100% owned by the state and has received policy approval from Parliament as part of the national budget. The government has also publicly disclosed the financing details through annual budget statements since 2018.

The lawsuit also challenges the constitutionality of a $10 billion COVID-19 Relief Bond transaction between the Ministry of Finance and the Bank of Ghana, which the AG’s office says was within lawful fiscal management measures adopted during the pandemic.
