The Accra High Court has directed the lawyers of former Chief Justice Gertrude Sackey Torkornoo to follow the proper procedure in discontinuing a case she filed challenging her removal from office. Justice Eugene Nyadu Nyantei presided over the hearing, insisting that Torkornoo’s lawyers file the necessary processes instead of withdrawing the suit orally.
Torkornoo had filed a judicial review application on June 23, 2025, asking the High Court to strike out a petition by a group known as Shining Stars of Ghana, citing fundamental flaws in the petition, including the group’s lack of registration and anonymous membership. During a virtual hearing on September 9, 2025, her lawyer, Kwabena Adu-Kusi, informed the court of his client’s decision to withdraw the application.
However, Deputy Attorney-General Dr. Justice Srem Sai expressed disappointment at the manner in which Torkornoo’s lawyers approached the court, arguing that they should have filed a notice of discontinuance instead of seeking to withdraw orally. “We are embarrassed by the applicant’s move this morning, mainly because the proper course of action for a person who has filed an originating process is to file a notice of discontinuance and not show up in court and seek orally to withdraw,” Dr. Sai stated.
Justice Nyantei ordered Torkornoo’s lawyers to file the necessary processes to discontinue the case and adjourned proceedings indefinitely. This development comes after President John Mahama removed Torkornoo from office on September 1, 2025, following recommendations by a Committee of Inquiry that investigated petitions seeking her removal ¹.
The Committee of Inquiry, chaired by Justice Gabriel Scott Pwamang, found Torkornoo guilty of stated misbehavior, including misappropriation of public funds and breach of judicial procedures. The President acted in accordance with Article 146(9) of the 1992 Constitution, which requires the President to follow the committee’s recommendations
