Court Dismisses Wontumi’s Application for Further Disclosures

The High Court has dismissed an application filed by lawyers for Bernard Antwi-Boasiako, popularly known as Chairman Wontumi, seeking further disclosures from state prosecutors in the ongoing case against him. Wontumi is accused of unlawfully permitting mining on his Samreboi concession without authorization.

Counsel for Wontumi, Andy Appiah Kubi, argued that the prosecution witness relied on a purported deed or agreement allegedly signed by Wontumi and another accused person, and therefore the defense needed copies of these documents to properly prepare for trial.

However, Deputy Attorney General Dr. Justice Srem-Sai strongly opposed the application, describing it as legally misconceived. The prosecution argued that the defense had failed to meet the requirement for further disclosures, which must be justified as exculpatory.

The court agreed with the prosecution, holding that the defense had not demonstrated any legal basis or justification for the documents requested. The case is expected to proceed to the next phase of the Case Management Conference.
